1. Introduction.

(A) Governing Terms. This website, including the features and services available from the site such as RSS feeds, podcasts, and embeddable video, blogs, articles (collectively “Timbermillsiding.com” or “Site”) is an interactive on-line ecommerce site owned and operated by Style Crest, Inc. ("Timbermill Siding"). These Terms of Service, along with any additional terms and conditions that are referenced herein or that are presented elsewhere on the Site in relation to a specific service or feature (collectively “Terms of Service”) and the Timbermill Privacy Policy, set forth the terms and conditions that apply to your use of TimbermillSiding.com. By using TimbermillSiding.com, you agree to comply with all of the terms and conditions hereof. If you do not agree to these Terms of Service, you should not access or use TimbermillSiding.com.

  • You agree not to upload, post or otherwise transmit, without TIMBERMILL's express prior approval, User Content which contains advertising or any solicitation with respect to products or services;

  • You agree not to upload, post or otherwise transmit User Content that does not generally pertain to the designated topic or theme of any Interactive Area;

  • You agree not to impersonate any person or entity, including, but not limited to, any TIMBERMILL employee, or falsely state or otherwise misrepresent your affiliation with any person or entity;

  • You agree not to interfere with any other user's right to privacy, including by harvesting or collecting personally-identifiable information about TimbermillSiding.com users or posting private information about a third party;

  • You agree not to upload, post or otherwise transmit any User Content, software or other materials which contain a virus or other harmful or disruptive component;

  • You agree not to interfere with or disrupt TimbermillSiding.com or the servers or networks connected to the Site, or disobey any requirements, procedures, policies or regulations of networks connected to the Site;

  • You agree not to upload, post, e-mail or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation;

  • • You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purpose, any portion of TimbermillSiding.com, use of TimbermillSiding.com, or access to TimbermillSiding.com;

  • • You agree not to use any robot, bot, spider, or other automated technology to monitor or copy any portion of TimbermillSiding.com

  • You agree not to upload, post, or otherwise transmit any User Content protected by copyright, trademark, trade secret, right of publicity or other proprietary right without the express permission of the owner of such copyright, trademark, trade secret, right of publicity or other proprietary right. The burden of determining that any User Content is not protected by copyright, trademark, trade secret, right of publicity or other proprietary right rests with you. You shall be solely liable for any damage resulting from any infringement of copyrights, trademarks, trade secrets, rights of publicity or other proprietary rights or any other harm resulting from such a submission. Any person determined by TIMBERMILL, in its sole discretion, to have violated the intellectual property or other rights of others shall be barred from submitting or posting any further material on TimbermillSiding.com;

  • You agree that if necessary, you have the consent of each and every identifiable natural person in any submission to use such persons name or likeness in the manner contemplated by TimbermillSiding.com;

  • Any conduct that in TIMBERMILL’s sole discretion restricts or inhibits anyone else from using or enjoying TimbermillSiding.com will not be permitted. TIMBERMILL reserves the right in its sole discretion to remove or edit User Content by you and to terminate your Account for any reason. (C) Monitoring. (D) License to User Content. 13. RISK OF LOSS

All items purchased from TIMBERMILL are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

17.  Pre-Order Price Guarantee

TIMBERMILL price for not-yet-released items sometimes changes between the time the item is listed for sale and the time it is released and shipped. Whenever you pre-order a product the price we charge when we ship it to you will be the lowest price offered by TIMBERMILL between the time you place your order and the release date. The order summary in Your Account will reflect the lowest price within 24 hours of the price change.

If your order enters the shipping process before the release date and the price is lowered on the release date, we will automatically refund your credit card for the difference between the price you were charged and the release-date price. If you didn't use a credit card to pay for your order, please contact customer service through the Contact Us button on the right side of any Help page.

18.   Post-Order Price Match Policy

We do not offer post-order price matching when an item's price drops after you buy it. Our prices regularly change, and the price you paid when your order shipped was the lowest price we were able to offer at the time. If for any reason you are not 100% satisfied with your purchase, just return the item for an exchange or refund. Satisfaction Guarantee Details:

Most items we sell are covered for one full year by the Timbermill Satisfaction Guarantee. When these products are used for commercial vehicles, the Guarantee is 90 days. There are a handful of exceptions, which are outlined below or on the product description pages. Only the items listed below require that you call or email us first for a return authorization. Siding and Siding Accessories Warranty

Limited, Lifetime 75 Year Transferable Limited Warranty

Because expert care is taken in the manufacturing process to ensure that our products perform to the highest standards, Style Crest, Inc. (SCI) warrants the performance of it’s vinyl siding, soffits and accessories (Products) to the Original Owner(s), against defects in material and workmanship for as long as the Original Owner(s) are living and are the owners of the property to which the Products were applied (the “Property”). In the event that there is more than one Original Owner(s), this limited warranty will remain in effect as long as any one of the Original Owner(s) is living and owns an interest in the Property. If the Products fail to be free from defects in material and workmanship during the warranty period, SCI will, upon notification in accordance with the claims procedure listed in this document and upon validation by SCI of the defects by inspection, either repair, replace or refinish, at its option, not to exceed original purchase price of material and installation. This limited warranty may be transferred to subsequent homeowner(s). Thenew homeowner(s) may receive limited warranty coverage for a period of 75 years from the date of the original installation provided that they supply written notice to SCI within 30 days after the transfer of ownership. Failure to notify SCI of the transfer shall relieve SCI of any further obligation. Please review the Warranty Transfer Section of this limited warranty for further details. In the event the Property is owned other than by an individual(s), including,
without limitation, a corporation, unincorporated association, school, church, government or public entity, the warranty period shall be 50 years (non-prorated) from the original date of installation

Coverage Exclusions and Limitations

This limited warranty does not cover damage of any kind resulting from improper installation, accidental damage, settlement of the substrate structure (such as distortion, warping, or cracking), structural shrinkage, alteration of the structure, fire, flood, lightning, ice, hail, hurricane, tornado, windstorm, earthquake, or other acts of God, acts of war or terrorism, vandalism, harmful
chemicals, fumes or vapors, misuse, abuse, normal weathering* or wear and tear, mildew accumulation, any owner(s) failure to provide reasonable and necessary maintenance of the Products** and damage from foreign objects, or other causes beyond the control of SCI. This limited warranty shall not apply to Products which have been painted or the surface altered in any way not authorized in writing by SCI

Limited Fade Warranty

SCI also warrants to you that the Products will not excessively fade. “Excessive Fading” is in defined as in excess of a Delta E of 4 Hunter unites, as determined by SCI.
* Normal weathering is defined as exposure to ultraviolet light and extremes of weather (including atmospheric pollution and acid rain) which will cause any colored surface to fade, darken, chalk, or acquire dirt or stains.
** SCI Vinyl Siding can be easily maintained by using a soft brush and a mild detergent. Refer to the Vinyl Siding Institute’s website - www.vinylsiding.org for complete cleaning instructions If the Products covered cannot be repaired, replaced or refinished, after a reasonable number of attempts at such repairs, replacements or refinishing, SCI shall provide a refund of the (original) purchase price. SCI is providing the Original Owner(s) an express lifetime limited warranty under the provisions of
the Magnuson-Moss Federal Warranty Act. SCI cannot and shall not be liablefor a breach of any other written or oral express warranties, without limitation, those given by dealers, contractors, applicators, or distributors of the Products

Any Implied Warranties Imposed By Law, Such As The Implied Warranties Of Merchantability And Fitness For A Particular Purpose, Are Limited In Time To The Duration Of This Express Warranty. SCI Shall Not Be Liable For Any Consequential Damages Or Incidental Damages for breach of any express, written, oral or implied warranty on the Products. The Owner(s) EXCLUSIVE REMEDY shall be for repair, replacement, or refinishing solely at SCI’s option, only in terms stated in this limited warranty.

Registration of the Limited Warranty

Warranty Transfer

All returns are recommended to be sent via a traceable carrier such as USPS, UPS or FedEx. Timbermill Siding is not responsible for packages not received if sent via a non-traceable carrier. Returns must be shipped prepaid. We do not accept C.O.D deliveries. Returns may take one to two weeks to process and at least one billing cycle for the credit to appear on your credit card statement.

Shipping & Handling Policy

For your convenience we use three methods of shipping our packages to our customers and they are as follows: UPS Ground which delivers in 3 to 5 days from the time of shipment. One advantage of UPS is that all orders are automatically insured up to $100.00 per shipment. If your order is in excess of the $100.00 limit additional insurance charges will be applied. We can ship UPS using their other options of Next Day, Second Day, as well as third day select but the most economical and the preferred way is UPS ground. When selecting UPS during the check out process the shipping charges will be calculated from the UPS calculator on the UPS web site.

USPS (United States Postal Service) ground service (which is parcel post) is the preferred way to ship within USPS which delivers in 2 to 8 days from time of shipment. If you select USPS as your method of shipment, please note that insurance is not included in the shipping charge and you will have to click on the insurance portion and add it to the order if you want your shipment to be insured. If you choose not to insure the package and it arrives damaged we are not responsible for the loss. When selecting USPS during the check out process the shipping charges will be calculated from the USPS calculator on the USPS web site.

A third option is Truck Freight for items indicated with a Truck (image) in the description. These are delivered by a freight carrier. The carrier will schedule a delivery time and provide curbside delivery, unless white glove service is advertised for the item. The customer is responsible for moving their goods into the house and setting it up. Assembly instructions are provided

The customer is responsible for all freight charges and restocking fees if they refuse delivery of these items. Both of the freight charges and the restocking fee will be subtracted from the customer’s refund when a customer refuses delivery or cancels their order while their merchandise is in transit. Please call for items that need to be shipped to Canada or Alaska.

The customer should inspect the merchandise for damages prior to signing the bill of lading for merchandise shipped via a freight carrier. Once the bill of lading is signed the customer owns the merchandise and is responsible for any damages.

If you have different shipping preference other than the three listed above please let us know and we will arrange for a quote and advise you of the actual charges for that method.

At the present time we do not ship overseas so if you live outside the United States or Canada please contact us and we will see what arrangements can be made to ship to your location. As always we are willing to combine items in order to reduce shipping costs all you have to do is ask us

Delivery Time

We ship orders within 48 hours on business days from the day that your order was received.
